2025 DEFENDER TROPHY NORTH AMERICAN COMPETITION - COMPETITION TERMS
The general terms and conditions set out below (the “Competition Terms”) apply to the 2025 DEFENDER Trophy North American Competition (the “Trophy Competition”) being run and administered by Jaguar Land Rover North America, LLC, 100 Jaguar Land Rover Way, Mahwah, New Jersey, 07495 (“Land Rover” / “Sponsor”) and its affiliate and group companies or any operator appointed by Land Rover.
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. THE TROPHY COMPETITION IS OPEN TO INDIVIDUALS WHO: (I) ARE TWENTY-THREE (23) YEARS OF AGE OR OLDER; (II) RESIDE IN THE 50 UNITED STATES, THE DISTRICT OF COLUMBIA (“D.C.”), OR CANADA; and (III) have a valid AND UNENCUMBERED driver’S license AND ARE INSURABLE.
The North American Trophy Competition is sponsored by Land Rover. Any questions, comments or complaints regarding this Trophy Competition should be directed to Sponsor. The Trophy Competition selection begins at 12:00:00 a.m. Eastern Time (“ET”) on July 22, 2025, and ends on November 30, 2025 11:59:00 p.m. ET. Date of Competition is scheduled for April 15th – May 5th, 2026.
Swivel Group, LLC’s (“Administrator”) computer is the official time-keeping device for this Trophy Competition. The Trophy Competition provides eligible individuals (the “Participants”) an opportunity to take part in a “Local off-road/ adventure competition” in the United States
Eligibility
Employees of JLR and authorized Jaguar and Land Rover retailers, as well as employees of any third party affiliated with the Trophy Competition, Land Rover’s parent companies, third party suppliers, subsidiaries, distributors and other prize suppliers, directors, officers, and each of their immediate family members (spouses, domestic partners, parents, grandparents, siblings, children and grandchildren), and household members, whether or not related, or Land Rover’s affiliates, advisors or media/advertising/promotion agencies/partners (and their immediate family and household members whether or not related) are not eligible to enter the Trophy Competition.
The Trophy Competition is open only to legal residents of the fifty (50) United States, District of Columbia and Canada, who: (i) are twenty-three (23) years of age or older; and (ii) have a valid and unencumbered driver’s license and are insurable. Void outside of the fifty (50) United States, District of Columbia and Canada and where prohibited or restricted by law.
Important Notes:
To be eligible, an individual must meet all of the requirements outlined in these Competition Terms (as determined by Sponsor in its sole and absolute discretion) at all relevant times. Participants are subject to verification of eligibility and identity at any time (including, but not limited to, a requirement to submit valid government issued photo identification) in order to verify compliance with these Competition Terms, or for any other reason. The Sponsor reserves the right at any time, in its sole and absolute discretion, to disqualify any individual if Sponsor determines that allowing such individual to participate in (or continue to participate in) the Trophy Competition could cause harm to an individual or property, or bring Sponsor into public disrepute or in any way adversely impact the good standing or reputation of Sponsor in the eyes of the general public. Sponsor’s decisions on all matters arising in this regard shall be final and binding without right of appeal.
Participant must have valid email addresses in order to enter the Trophy Competition and to be eligible to win the opportunity to progress to the Global Final (as defined below).
Participant must be at least twenty-three (23) years of age to enter the Trophy Competition and claim the Grand Prize (as defined below).
Participant must be able to travel to Stave Lake in Mission, British Columbia Canada for a two (2) consecutive day period during between April 15th 2026, and May 5th , 2026 (actual dates to be determined by the Sponsor in its sole and absolute discretion). All travel to and from Competition venue is the responsibility of the Participant. JLR will provide accommodations and food and beverage, and uniforms. Participants must bring their own clothing, personal care items, and medication (as applicable).
Participant must hold a valid and unencumbered United States or Canadian driver’s licenses (equivalent to a full “G” class license in Ontario, Canada) and be able to complete driver’s license declaration forms. Land Rover reserves the right to check the driving history to confirm that Participant has at least three (3) years uninterrupted driving experience on a valid driver’s license without a conviction for any driving offenses or serious accidents (which includes any accident involving any form of personal injury) in the last two (2) years.
Participant must be in good physical condition and have no injuries, ailments or impairments that could jeopardize their safety or the safety of others while participating in the Trophy Competition and will be required to sign an additional release and waiver as provided by Land Rover.
Participant’s entry into the Trophy Competition is subject to the acceptance of, and compliance with, these Competition Terms, and any terms contained in applicable promotional material.
Entry
There will be a total of up to 44 Canadian and 190 American slots available to progress to the North American Trophy Competition (as defined below). The deadline to submit all required materials (an “Entry”) is November 30, 2025, at 11:59 p.m. ET unless otherwise extended at the discretion of Land Rover.
Limit one Entry per Participant. A Participant may only use one email address to enter the Trophy Competition. A Participant is not permitted to share the same email address with another Participant. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected Entries all of which will be ineligible. Any attempt by any Participant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will be void and your Entries will be disqualified. Incomplete or illegible Entries will not be acknowledged.
To enter the Trophy Competition and potentially win the opportunity to progress to the Global Final (as defined below), Participants must complete the online form, by adding their information, answering all questions and uploading a one (1) minute video. Authorized Land Rover Retailers may also nominate and sponsor an individual.
Land Rover will use the email addresses used by Participant to communicate about the Trophy Competition, its products and services, and its retailers, subject to opt- in consent by Participants. Eligible Participants must include, among other things, the following information on the form: first and last name; age; email address; physical address; gender
During the Entry Submission Period upload a video of up to one (1) minute in length that:
a. Amateur and professional videos are welcomed. Participants may use any type of video device to record videos, but it is recommended all videos be filmed in the widescreen or horizontal screen orientation. Your video must align with the criteria outlined in these Competition Terms.
b. Video to include the applicant in the video frame explaining how he or she embraces their impossible and why they should be selected as an attendee of the North American DEFENDER Trophy Selection Competition
c. The qualifying question answers and video submitted through the application will be scored on Defender Brand fit, as well as likelihood of success at the selection competition.
d. If video is large in size and participant has an issue transferring the video via the application form, participant will have the option to reach out to technical support at help@rsvpdefender.com and request a DropBox link.
e. Entries are considered incomplete until both the entry form and video entry are received. All registration information must be completed in full.
f. Participants will be required to register when submitting entries, including checking a box agreeing to the terms of the Competition Terms and providing their contact information (e.g., name, address, email, and phone).
g. By submitting an entry, each Participant expressly consents to the Sponsor, its agents and/or representatives storing, sharing and using their personal information submitted based on the Participant’s country of residence and in accordance with Sponsor’s Privacy Policy (the “Privacy Policy”) in that country available at https://www.landroverusa.com/privacy-policy.html or https://www.landrover.ca/en/privacy-legal.html provided, that in the event of any conflict between the Rules and the relevant Privacy Policy, the terms and conditions of these Competition Terms shall prevail only with respect to the conduct of this Trophy Competition.
h. Any statements or claims made about (or by) the Participant in the video must be truthful. Any dialogue in the video must be in English or have English subtitles.
i. For any music included in the video, Participants must be able to provide proof they have secured the rights to use that music for the Trophy Competition, advertising, publicity and promotional purposes in the US and Canada.
j. Other than Sponsor, its products, brands, logos, or products, brands or logos owned solely by the Participant, the video may not show, contain, mention, depict, refer or otherwise allude to the name, logo or product of any third party, unless the Participant has obtained written approval from such third party to use, and sub-license the use, of such name, logo or product in the Entry.
k. If any other persons appear in or were involved in the creation of the footage comprising a video (including without limitation person(s) or entities who appear in the video or who assist with recording the video other than the Participant), Participants agree that prior to submitting a video, that they have obtained the written consent of each such person or entity, granting Sponsor and its designees the use of each person or entity’s name, biographical information, image and/or likeness for advertising, publicity and promotional purposes relating to this Trophy Competition and as otherwise provided for herein.
*LIMITED LICENSE: THE SPONSOR’S TRADEMARKS MAY BE REFERENCED IN THE VIDEO FOR PURPOSES OF THIS TROPHY COMPETITION ONLY. NO OTHER RIGHTS IN OR TO SPONSOR’S TRADEMARKS ARE GRANTED UNDER THESE COMPETITION TERMS AND PARTICIPANT MAY NOT USE THE VIDEO FOR ANY PURPOSE OTHER THAN ENTERING THIS TROPHY COMPETITION.
By submitting a video, Participants warrant and represent that:
a. it is, in its entirety, the Participant’s own original work and/or that the Participant has obtained all necessary rights in and to the Entry (where applicable);
b. it has not been previously published, released or distributed in any form;
c. statements and claims made are truthful;
d. it does not violate any law, statute, ordinance or regulation, violate or infringe upon the copyrights, moral rights, trademarks, privacy, publicity or other personal or proprietary rights or any other rights of any person or entity and must not give rise to any claims whatsoever, including, without limitation, claims of infringement or invasion of privacy or publicity or infringe on any rights and/or interests of any third party;
e. the video is suitable for presentation in a public forum;
f. publication of the video via various media, including but not limited to the Sponsor’s websites and social media channels, will not violate or infringe on the rights of any third party; and
g. it does not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the legal age of majority in their jurisdiction of residence.
Release By submitting an video, Participants hereby agree to release, indemnify and hold harmless the Sponsor, its affiliates, partners, agents, directors, and employees and the Administrator from and against any and all claims, damages, liabilities, costs, and expenses arising from use of your video, including, without limitation, any claim based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related or other cause of action whatsoever. THIS RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE TROPHY COMPETITION AND/OR AWARDING OF ANY PRIZE.
Prohibited Content No Entry may contain, mention, refer or otherwise allude, to disreputable content, including but not limited to any of the following: a) Sexually explicit, lewd, disparaging, morally offensive or suggestive content; violent content or dangerous stunts; content which promotes discrimination based on ethnicity, race, nationality, disability, gender, religion, profession, age, sexual orientation, or any other basis protected by federal, state/provincial/territorial, or local law, ordinance, or regulation; or any profane or pornographic content; b) References to sports betting, lotteries, gambling, alcohol, illegal or performance enhancing drugs, tobacco, e-cigarettes, cannabinoid or synthetic THC products and any related paraphernalia, firearms/weapons/ammunition (or the use of any of the foregoing); content that promotes any activities that are unsafe or dangerous, or any political agenda or message; c) Obscene or offensive material including cursing and offensive language; promotion or endorsement of bigotry, any form of hate speech or hate group or otherwise contain inappropriate content or objectionable material; d) Content that is a duplicate of any other Entry’s content; e) Content that defames, misrepresents or contains disparaging remarks or reflect negatively upon Sponsor, other companies or other people or is libelous, defamatory, disparaging, tortuous or slanderous; f) Personal identification of anyone other than the Participant, such as full names (first and last) without written permission, license plates, e-mail addresses or street addresses; g) Material embodying the names or other indicia that identify any person, living or dead, other than the Participant; h) Messages or images explicitly or implicitly inconsistent with the positive images and/or goodwill to which the Sponsor wishes to associate; or i) Content that infringes the rights of any third party or promotes illegal activities; and/or violates any law. The Entry cannot itself be in violation of any law, policy, guideline or ordinance and must otherwise be in compliance with these Competition Terms.
Publicity Entries are not permitted to be shared publicly by any Participant (including without limitation on Participant’s personal social media accounts). Posting of an Entry on any social media platform will result in disqualification of said Entry
BY SUBMITTING AN ENTRY, PARTICIPANT ACKNOWLEDGES THAT THE ENTRY MAY BE POSTED ON SPONSOR’S WEBSITES OR ELSEWHERE ON THE INTERNET AS AUTHORIZED BY SPONSOR, IN ITS DISCRETION.
Participant further acknowledges that Sponsor is not obligated to post or use any Entry. By submitting an Entry, Participant fully agrees to hereby grant the Sponsor and its affiliates, subsidiaries, assigns, licensees, and designees the irrevocable, perpetual, worldwide, royalty-free right and non-exclusive license to use, publish, reproduce, edit, translate, create derivative works from, to incorporate it into other works, in any form, media or technology now known or later developed, market, store, distribute, have distributed, publicly and privately display, make available, communicate, publicly and privately perform, transmit, and have transmitted the Entry or portions of the Entry for any purpose, including, without limitation, the purpose of administering the Trophy Competition and judging the Entries. Participant also grants a waiver and full release relating to the Entry, including without limitation waiving rights of publicity or privacy. Participant hereby waives all moral rights in and to their Entry (and each component thereof) in favor of the Sponsor (and anyone authorized by the Sponsor to use such Entry). Participant will be required to sign a document to this effect and failure to sign this document will void the Entry. Should Sponsor fail to request the said assignment as stated, that shall not be deemed a waiver of Sponsor’s rights and Sponsor may at a later time request the assignment.
ENTRIES POSTED TO SPONSOR’S WEBSITES, IF ANY, ARE NOT EDITED BY SPONSOR AND ARE THE VIEWS/OPINIONS OF THE INDIVIDUAL PARTICIPANT AND DO NOT NECESSARILY REFLECT THE VIEWS OF SPONSOR IN ANY MANNER. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to Participants.
Entries that do not comply with the above guidelines, or that otherwise contain prohibited or inappropriate content, as determined by the Sponsor, in its sole discretion, will be disqualified. Entry must not contain material that is harmful to others, such as viruses, Trojan horses or other technologies that could adversely impact the Trophy Competition or any person’s computer or other device. By submitting an Entry, Participants agree that their Entry is gratuitous and made without restriction and will not place Sponsor under any obligations other than those contained in these Competition Terms, that Sponsor is free to use or otherwise disclose the ideas and content contained in the Entry on a non-confidential basis to anyone or otherwise use the ideas and content without any additional notice or compensation. Participants acknowledge that, by acceptance of an Entry, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than Participant. By entering the Trophy Competition, Participants acknowledge that they will not now or in the future be paid or compensated in any way for an Entry or for granting the Sponsor any of the rights set out in these Competition Terms. Participants further acknowledge that Sponsor is not obligated to make use of any of the rights granted in these Competition Terms.
Participant Selection: To be eligible for the Trophy Competition, an eligible Entry must be received during in accordance with these Competition Terms. During the Judging Period starting on or before 11:59 PM EST, December 1, 2025 – 11:59 PM EST January 30, 2026, each Entry will be individually judged and scored by qualified judges appointed by Sponsor based on the following required criteria:
DEFENDER Trophy Form (25% of total): qualifying questions will be provided at the time of entry
DEFENDER Trophy Video Judging Criteria (75% of total):
1. Built to Last
a.Criteria: Demonstrates a mindset and actions rooted in long-term impact, and resilience
2. Stuff of Stories
a. Criteria: Exhibits bold originality and a willingness to challenge the norm in pursuit of meaningful, inspiring outcomes.
3. Shared Mission Mindset
a. Criteria: Embodies a collaborative spirit, aligning personal drive with collective purpose to elevate the team and mission.
4. Individual’s Brand Fit
a. Criteria: Shows a natural alignment with the brand’s spirit—living its values, representing its voice, and embodying what it means to be truly Unstoppable.
These factors will be weighted accordingly: (a) 30%, (b) 30%, (c) 30%, and (d) 10%.
Entries that receive the highest combined scores according to the criteria listed above, in the sole determination of the judges and subject to the verification eligibility and compliance with these Competition Terms, (each a “Finalist Entry”).
In the event of a tie, the tied Entries will be re-judged by an additional panel of judges appointed by the Sponsor who will serve as a tiebreaker, and which will evaluate tied Entries according to the criteria listed above. If following re-judging the entries are still tied, the Entry that received the highest score for criteria (d), as determined by the qualified judges in their sole discretion, will be deemed a winner (subject to verification) from among the tied Entries.
PARTICIPANT NOTIFICATIONS: Participants associated with an eligible Finalist Entry will be notified no later than February 28th , 2026.
Each Participant who is associated with an eligible Finalist Entry will be notified by telephone or email at Sponsor’s discretion. Sponsor reserves the right to select no Participant, if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries.
Odds of being selected as an eligible participant depend on: (i) the caliber of each Entry; (ii) the number of eligible Entries received during the Entry Submission Period; and (iii) the score obtained during the Judging Period. Judging is scheduled to be completed on or before January 30th 2026.
Participants must each execute and return an affidavit of eligibility, a liability release and, unless prohibited by law, a publicity release, and any other documents required by Sponsor, within three (3) days of date of issuance specified in the email notifications. If any such Participant does not respond within three (3) business days of the date of issuance specified in the email notifications or phone messages, or if they fail to comply with these Competition Terms, or is otherwise deemed ineligible by Sponsor or Administrator, then the participant will not advance to the next stage of the Trophy Competition.
Failure to return the documents listed above or reply to the email and/or phone call with the requested information, within the specified time-period, the return of any notification as undeliverable, noncompliance with these Competition Terms, or Sponsor’s inability to contact a potential participant within the specified time-period may result in forfeiture of potential status and, at Sponsor’s sole discretion.
No messages will be left on answering machines or voice mail systems. Administrator is not responsible for technical difficulties with internet servers or other telecommunications systems beyond its control.
Once confirmed as a Finalist Entry, the Participant associated with such Finalist Entry may be announced in any media as determined by Sponsor in its sole discretion. Participants will be prohibited from disclosing they have been chosen until after Sponsor publicly announces the identity of the Participants.
Please Note: As a condition of participating in the Trophy Competition, Participants must agree to be recorded on video, interviewed, and/or photographed at the time the prize is awarded or for additional publicity required by Sponsor. Any video, interview, and/or photographs taken by the Sponsor or Sponsor’s representatives, may be featured on local and national media and may be used by the Sponsor without further notice for advertising and marketing purposes in any and all media now known or hereinafter invented without territorial or time limitations and without additional notice or compensation, except where prohibited by law.
Furthermore, Participants must provide proof and certify that they comply with the requirements and conditions of these Competition Terms.
Prize
Only the prize listed below will be available to be awarded to this segment of the Trophy Competition.
Grand Prize: A total of two representatives from the United States and two representatives from Canada will win a trip to Africa to Compete with other finalists in an off-road driving competition/ adventure (the “Global Trophy Competition”) which will be recorded and published, including but not limited to the DEFENDER YouTube Channel. Timing of the Grand Prize is scheduled for the month of October 2026. A Land Rover Representative will communicate the dates at least 90 days before the first day of the experience.

Itinerary for the Final Global Trophy Competition will be provided to the winners at time of prize notification. Winner must travel on the day before the schedule start of the competition or the Final Competition will be forfeited, and Land Rover will have no further obligation to winner. Travel and accommodations are subject to availability and blackout dates and must be made through Land Rover’s agent. Travel cannot be changed once booked. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in the Final Competition Terms.
All expenses and incidental travel costs associated with prize acceptance and use not expressly stated in the package description above as being provided, including but not limited to, ground transportation, meals, incidentals, gratuities, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of the winner.
Land Rover will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Land Rover is not responsible if the Global Trophy Competition or any other aspect(s) of the Grand Prize is delayed, postponed or cancelled for any reason, in which event that portion of the prize is forfeited in its entirety and no substitution will be provided except as in Sponsor’s sole discretion.
Approximate Retail Value (“ARV”) of the Grand Prize is $35,000 USD // $47,880.00 CAD Actual value may vary based on airfare fluctuations and distance between departure and destination. Winner will not receive difference between actual and approximate retail value. Grand Prize is non-transferable, cannot be taken as cash, and no substitution will be made except as provided herein at Land Rover’s sole discretion. Land Rover reserves the right to substitute the Grand Prize (or portion thereof) for one of equal or greater value, at its sole discretion. Winner is responsible for all taxes and fees associated with prize receipt and/or use. All prize details are at Sponsor’s sole discretion.
Limit: One (1) per person/household. If an agreement cannot be reached with winner within seven (7) days of notification of the Global Trophy Competition, Land Rover may select an alternate winner for the Global Trophy Competition with the assistance of the judging panel.
The winner acknowledges that the Global Trophy Competition is an “experience” and not a vacation. The winner will be expected to participate in long days of driving with potentially other participants in the vehicle.
Winner acknowledges that the driving portion of the Global Trophy Competition may include dangerous activities which may result in injury or death, and winner’s participation in the Global Trophy Competition at their own risk. By accepting the Grand Prize and participating in the Global Trophy Competition the winner represent that they are in good physical and mental health, and do not suffer from any condition or injury which might jeopardize their health or safety during participation in the Global Trophy Competition.
Requirements, Restrictions and Exclusions
The winner must have, and is solely responsible for obtaining, all necessary identification and/or travel documents and visas required for travel, including, but not limited to, a passport valid for at least 6 months at the time of travel and any necessary Visas and vaccinations. Land Rover may assist where necessary in its sole discretion.
1. Participants will be required to sign liability and media permission waivers
2. Winner must comply with all COVID-19 guidelines and any executive orders and directives issued by local government authorities as part of their response to the COVID-19 public health emergency.
3. The winner’s names used for the Trophy Competition entry must match valid government issued identification.
4. A valid credit or debit card may be required for security deposit purposes when checking into any hotel included in a the Grand Prize.
5. Released Parties (defined below) are not responsible for any cancellations, delays, diversions or substitutions, or any act or omissions whatsoever by the air carriers, hotels, venue operators, transportation companies, third party prize providers or any other persons involved in providing any prize-related goods, services or accommodations.
6. Released Parties will not be responsible for missed flights, trains, buses, etc. for any reason, winner’s failure to book or confirm the same consistent with Land Rover’s instructions, or any resulting expenses.
7. Released Parties are not responsible if winner is denied entry to, or re-entry from, any aircraft, Africa, Canada, the United States, or layover location. In such event, the winner will be solely responsible for all additional expenses incurred and may waive participation in this experience, in whole or in part.
8. The winner may share a vehicle and driving time with other competition participants for the duration of the trip (any vehicle changes will be at the absolute discretion of Land Rover).
9. In the event of war, terrorism, state of emergency, pandemic or disaster, Land Rover reserves the right to cancel, terminate, modify or suspend the Trophy Competitions.
10. The Global Trophy Competition if won, could result in time off from work or study. Winner ensure prior to entering the competition that you are able to take this time off from work or study, where necessary. It is the sole responsibility of the winner and travel companion to arrange time off if necessary.
11. To the fullest extent permitted by applicable law, the travel and accommodations of the Global Trophy Competition will be awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
12. Land Rover retains absolute discretion to decide whether the winner is fit to travel; the winning team (at its own expense) may be required to provide a certificate of good health by a medical practitioner. Land Rover will not be liable to pay compensation to any winner who is deemed unfit or unable to travel.
EVENT
In order to enter the Trophy Competition, you must follow the entry process set forth above.
1. The participant must compete in a 2-day program (see description below) at the DEFENDER Trophy North American Competition at Stave Lake in Mission, British Columbia Canada between April 15 2026, through May 5th 2026. The vehicles provided for the DEFENDER Trophy North American Competition will be Canadian specification and no protest or complain can be made due to market variations. Trophy Competition instructions will be communicated in the English language and measurements and units will use the US Imperial system.
2. The participant will receive competition instructions during participation.
3. This Defender North American Trophy Competition will include some physical exertion, problem solving and off-road driving challenges as well as teamwork exercises. All competitive activities will be scored based on accuracy and time.
4. All eligible and qualified entries are deemed to be eligible to compete for the Grand Prize.
5. Participation is limited to one entry (i.e., a single DEFENDER Trophy North American Competition entry).
6. Participant must have a sense of adventure and be ready for a challenge as part of their participation in the Trophy Competition. As discussed further below, during the Defender North American Trophy Competition, a judging panel selected by JLR will record the scores, times and penalties. The judging panel will select winners.
7. Participants agree that, by participating in the Trophy Competition, Land Rover may use their names, images or likenesses in any manner (including a photograph, film or recording of the same) and in any medium now or hereafter devised, for our advertising, promotional and other purposes, worldwide, in perpetuity, without additional compensation, notification or permission, except where prohibited by law. Participant will be required to sign a document to this effect and failure to sign this document will deem the Participant ineligible to enter the Trophy Competition.
8. By participating in the Trophy Competition, participants agree that Land Rover may photograph, film and otherwise record them. Participants agree that Land Rover shall own all rights, moral rights, title and interest in the Trophy Competition footage and that Land Rover, its designees, successors and assigns may exploit, edit, modify, post, create derivative works of, distribute and otherwise use the footage and all elements of such, including the names, likenesses, voices and performances of individuals embodied therein in whole or in part, in any manner, in any and all media now known or hereafter devised, worldwide in perpetuity, without compensation, notification or permission from participant, their heirs, successors, and assigns, or any third party. Participant will be required to sign a document to this effect and failure to sign this document will deem the Entrant Participant ineligible to enter the Trophy Competition.
9. Land Rover reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who Land Rover has reason to believe has breached any of these Competition Terms, tampered with the entry process or engaged in any unlawful or other improper conduct calculated to jeopardize fair and proper conduct of the Trophy Competition. Errors and omissions may be accepted at Land Rover’s discretion. Failure by Land Rover to enforce any of its right at any stage does not constitute a waiver of those rights. Land Rover’s legal rights to recover damages or other compensation from such an offender are reserved.
10. If there is a dispute as to the identity of an entrant, Land Rover reserves the right, in its sole discretion, to determine the identity of the entrant.
11. Land Rover reserves the right to disqualify any entrant (and void all associated entries) that it feels has sought to take an unfair advantage over other entrants by using such technologies or otherwise in its sole discretion.
12. Released Parties will not be responsible or liable for: (a) any failure to receive entries due to transmission failures and other conditions beyond its reasonable control; (b) any disruptions, injuries, losses or damages caused by events beyond the control of Land Rover; or (c) other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Trophy Competition, including, without limitation, errors or difficulties which may occur in connection with the administration of the Trophy Competition, the processing or judging of entries, the announcement of Prizes or in any Trophy Competition-related matters.
DETERMINATION OF THE NORTH AMERICAN DEFENDER TROPHY COMPETITION WINNER
The Trophy Competition is an exercise of skill and chance plays no part in determining the winners. The Trophy Competition involves selection of a winner by a judge or judging panel during the Competition. The Grand Prize winner will be selected from all valid entries in the Trophy Competition. A different panel of judges may be used for each “heat” of the Trophy Competition. Odds of winning depend on: (i) the calibre of the participant’s performance in the challenges; (ii) the number of entrants the day of the Trophy Competition; and (iii) the score the participant obtain during the Trophy Competition.
The judging panel will judge and record the scores, times and penalties. Rankings as judged are final. In the event of a tie for any Trophy Competition wave, a judge will determine the winner based on the fastest cumulative time across timed challenges. Land Rover reserves the right to not award a Grand Prize if, in its sole opinion, it does not receive a sufficient number of eligible and qualified entries. Judging scores will not be revealed.
The relevant judging panel will select the winning entry for the Trophy Competition based on a fair objective judging criteria. Land Rover reserves the right to amend the judging criteria before the start of the Trophy Competition to account for weather, local conditions, or current events the day of the Competition. Entrants’ chances of winning depend on their skill in completing challenges during the allotted time during the Trophy Competition and meeting the applicable criteria to the satisfaction of the judges.
Scoring: There will be up to 16 different “challenge” activities as part of the Trophy Competition, each assigned a maximum number of points.
1) For timed challenges, any penalties assigned will be in the form of “added time” . The individual who completes the challenge in the fastest time overall, including the added penalty time will receive the highest score. The individual with the second fastest time, including any added penalty time will receive the second highest score. The scoring process will continue for the rest of the attending individuals.
2) For “Point Collection” challenges, the individual who gathers the most points will receive the highest score, the individual who collected the second most points will receive the second highest score. If there are two individuals who collected the same amount of points then the individual who collected those number of point faster will receive a higher score.
3) During the competition, the scoring team will have the ability to add bonus points for individual’s attitudes and brand fit.
a. Brand Fit is an essential ingredient to a participant’s compliment of skills. As an attribute, it cannot be measured by time or distance, but it can be highly evident in an individual's attitude, approach, demeanour, confidence, positivity and openness.
b. Once candidates are in their final rankings after all competitive scoring tasks, a Brand Fit score of up to an additional 20% of their final score can be added to their score to provide additional points to uplift the exceptional candidates that demonstrated excellent Brand Fit.
4) The overall individual scores for each “heat” may be modified on a uniform scale depending on elements outside of the team’s control. For example, extraordinary weather
5) Failure to complete a challenge may result in zero (0) points.
6) Any intentional negligence while driving and /or vehicle damage may result in a disqualification of competition.
7) The Trophy Competition Winners will be the individuals that have the highest number of points across all challenges at the end of competition.
8) Exact task scores will not be shared until after the event if requested and an official protest must be filed with the competition manager on the day of competition. The competition manager has the ultimate authority and discretion in rules, violations, and protest actions.
Land Rover reserves the right to verify the identity and age of the winners prior to awarding any Grand Prizes. Trophy Competition winner may also be subject to a criminal record or associated background check to ensure suitability of representing the brand.
The Trophy Competition winner will be notified by e-mail. The winners of the Grand Prize will have seven (7) days from the date and time the notification was sent to claim the prize by replying in the way required in the notification.
If the winner (or later substitute winners) of the Grand Prize dos not respond within this timeframe, Land Rover reserves the right to disqualify the winner and instruct the judging panel to select substitute winners, at its sole discretion.
The Trophy Competition winning team members’ names and states may be made available by Land Rover on the Trophy Competition website for a limited time once the winner has been selected.
Third party suppliers of the Grand Prize (including venues) may also often stipulate their own terms, conditions or restrictions and all prize winners agree to be bound by these.
The winner may be required to sign and return any documents reasonably requested by Land Rover including an Affidavit of Eligibility and Liability/Publicity Release, prior to receiving any portion of the Grand Prize. Failure to return any required document by the date requested will render the potential winner ineligible to receive the Grand Prize. If any documentation is not returned as requested within 72 hours of notification via transmission to the email address provided in the entry or other method, or if a potential winner is deemed ineligible prior to a Grand Prize being awarded, Land Rover may, in its sole discretion, award a Grand Prize to the next alternative potential winner selected by the judging panel.
The winner of the Trophy Competition must also participate in the Final Global Trophy Experience, which is non-transferable.
PRIVACY AND PUBLICITY
By entering the Trophy Competition, you consent to the collection, use and disclosure of your personal information by Land Rover and its authorized agents for the purposes of administering the Trophy Competition and, if you are a winner, fulfilling the Grand Prize. You may have the opportunity to request to receive future electronic communications from Land Rover about its products and services. If you consent to receive such communications, you may unsubscribe at any time. Your personal information may be stored on servers located in the United States, the United Kingdom and/or other jurisdictions and may therefore be subject to the laws of such jurisdictions. Your personal information will be managed with the terms of Land Rover’s Privacy Policy available here for the United States: http://www.landroverusa.com/privacy-policy.html (as may be amended from time) and https://www.landrover.ca/en/privacy-legal.html provided that in the event of any conflict between the Terms and Conditions and the relevant Privacy Policy, the Terms and Conditions shall prevail only with respect to the conduct of this Competition and which are incorporated into these Competition Terms by reference.
By participating in the Trophy Competition, each Participant signifies that they have read and agree to be legally bound by these Competition Terms, by the Sponsor’s Privacy Policies, available at https://www.landroverusa.com/privacy-policy.html and https://www.landrover.ca/en/privacy-legal.html and by the decisions of the Administrator and Sponsor, which shall be final and binding in all respects, without any right of appeal.
GRANT OF RIGHTS
All Entries will become the property of Sponsor and will not be acknowledged, returned or cancelled, and no correspondence will be entered into regarding the status of any Entry, except as provided herein. In the event of a dispute as to who submitted an Entry, the name of the “authorized account holder” associated with the email account will be deemed to be the Participant and must comply with these Competition Terms. The authorized account holder of the email address is defined as the natural person who is assigned to the email address by an Internet access provider, online service provider, or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. Sponsor will not verify receipt of Entries. Proof of submission of an Entry does not constitute proof of receipt by Sponsor.
Sponsor, Administrator, their respective parent companies, affiliates, subsidiaries, distributors and each of their respective shareholders, directors, officers, employees and agencies (“Released Parties”) are not responsible for Entries that are late, lost, illegible, unintelligible, invalid, damaged, misdirected, garbled or incomplete, altered or otherwise irregular, that contain false information, that are generated by script, macro or other automated or mechanical means, that have been submitted through illicit means or by any means which subvert the entry process or that do not conform with or satisfy any or all of the conditions set out here, all of which are ineligible and void. Use of any automated program or method to enter will result in disqualification of all associated Entries and of the person/email address account responsible for such Entries. If entering via a mobile phone or other web-enabled device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply.
RELEASE
By participating in a Trophy Competition, to the fullest extent permitted by applicable law, participants agree to release, discharge, indemnify and hold harmless the Released Parties from and against any and all claims, liability, costs, losses, damages or injuries of any kind arising out of or related to participation in the Trophy Competition, the participant’s breach of these Competition Terms, and/or related to any Grand Prize or component of the Grand Prize (including any travel or activity related thereto). Participants will be required to sign a release and/or any other third party related to the Trophy Competition and failure to sign these releases will deem participants ineligible to enter the Trophy Competition.
By participating in the Trophy Competition, participants agree: (a) to hold harmless the Released Parties from and against any liability whatsoever and to waive and release the Released Parties from any and all causes of action, for any claims, expenses, injuries, losses or damages of any kind (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, intellectual property rights, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional) arising out of or in connection with the acceptance, possession, or use/misuse of any prize, participation in any Trophy Competition-related activity, or participation in the Trophy Competition, whether under a theory of contract, torts (including, without limitation, negligence), warranty, or any other theory or cause of action. (b) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) to the fullest extent permitted under applicable law (and except where prohibited for individuals resident in the province of Québec), all causes of action arising out of or connected with this Trophy Competition, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) to the fullest extent permitted under applicable law, any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. If your Entry is selected as a winner, participants’ information may be included in a publicly available winners list.
The winner of the Trophy Competition agrees (for himself or herself and his or her heirs) that, by accepting the Grand Prize, to the fullest extent permitted by law, the Released Parties will have no liability, and will be held harmless by thew winner for any liability, loss, injury or damage to property or person, including death, and reasonable legal fees and court costs, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the Grand Prize or participation in the Trophy Competition, save that nothing in these Competition Terms shall be construed to limit or exclude any liability of a Released Party for fraudulent misrepresentation, fraud, death or personal injury caused by a the Released Party’s negligence or any other liability to the extent the same may not be excluded or limited as a matter of law.
By accepting a prize, Winners agree to release the Released Parties and hold them harmless from any and all liability whatsoever for any injuries, losses, harm, damage, cost, and/or expenses whatsoever (including without limitation, all attorneys’ fees and court costs incurred) arising from or in connection with participation in the Trophy Competition or the awarding, receipt, possession, use, or misuse of a Prize. Participation in the Trophy Competition will further constitute and signify Participant’s (or their parent/legal guardian if considered a minor in their jurisdiction of residence) agreement and consent that Sponsor and/or Sponsor’s assignees may use the Participant’s name and likeness (if applicable) and/or biographical information in any media worldwide without limitation for promotional purposes without further compensation.
If, for any reason, the Trophy Competition is not capable of running as planned by any cause, including fraud, computer virus and electronic, network, computer or other technical malfunctions, which, in the sole opinion of the Sponsor, corrupts or affects the administration, security, fairness, integrity or proper conduct of the Trophy Competition , Sponsor reserves the right, at its sole discretion to cancel, terminate, modify or suspend the Trophy Competition and, if terminated, at Sponsor’s discretion, to judge and determine winners from among all eligible, non-suspect Entries received up to time of such action or as otherwise deemed fair and equitable by Sponsor. No more than the stated number of winners in these Competition Terms will be awarded.
DISPUTES
Except where prohibited by law (and specifically where prohibited for individuals resident in the province of Québec), Participants and Winners agree that: (1) any and all disputes, claims and causes of action arising out of or connected with this Trophy Competition or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the state of New Jersey without regard its conflict of laws principles with venue in New Jersey, and all claims must be resolved in the courts of New Jersey; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Trophy Competition , and in no event will Participants or Winners be permitted to obtain attorneys' fees or other legal costs; and (3) unless otherwise prohibited, under no circumstances will Participants or Winners be permitted to obtain awards for, and Participants and Winners hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
To the fullest extent permitted under applicable law (and except where prohibited for individuals resident in the province of Québec), all issues and questions concerning the construction, validity, interpretation and enforceability of these Competition Terms, or the rights and obligations of the entrant and Sponsor in connection with the Trophy Competition shall be governed by, and construed in accordance with, the laws of the state of New Jersey, without giving effect to any choice of law or conflict of law rules (whether of the state of New Jersey or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of New Jersey. The invalidity or unenforceability of any provision of these Competition Terms shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Competition Terms shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In the event of any discrepancy or inconsistency between these Competition Terms and disclosures or other statements contained in any Trophy Competition-related materials or made by any representative of Sponsor, these Competition Terms shall prevail, govern and control.
In the event of any discrepancy or inconsistency between these English Competition Terms and disclosures or other statements contained in any Trophy Competition-related materials, including, but not limited to, the French version of these Competition Terms, point of sale, television, print or online advertising and/or any instructions or interpretations of these terms given by any representative of the Sponsor, the terms and conditions of these English Competition Terms shall prevail, govern and control to the fullest extent permitted by law.
GENERAL
In the event of exceptional circumstances outside its reasonable control and only where circumstances make this unavoidable, Land Rover reserves the right to cancel or amend the Trophy Competition or these Competition Terms at any stage but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.
To the fullest extent permitted by applicable law, Land Rover excludes all liability for any costs, expenses, loss or damage whether direct, indirect, consequential or economic arising (whether in contract, tort or otherwise) out of or in connection with your participation in the Trophy Competition, entry into these Competition Terms or receipt or use or misuse of the Grand Prize (including travel or activity related thereto).
The decisions of Land Rover are final and legally binding on all entrants, and no correspondence will be entered into with entrants or any other person except as contemplated herein.
The Trophy Competition is subject to all applicable United States federal, state and local laws and Canadian federal, provincial, and local laws.
The Trophy Competition and these Competition Terms are governed by the internal laws of the State of New Jersey, without regard to its conflict of law principles, except where prohibited by law. To the fullest extent permitted under applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Competition Terms, or the rights and obligations of the entrant and Sponsor in connection with the Trophy Competition shall be governed by, and construed in accordance with, the laws of the state of New Jersey, without giving effect to any choice of law or conflict of law rules (whether of the state of New Jersey or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of New Jersey. Any legal proceeding concerning these Competition Terms must be brought exclusively in the state or federal courts located in New Jersey and you irrevocably submit to the personal jurisdiction and venue of such courts, except where prohibited by law.
In the event of any discrepancy or inconsistency between the terms and conditions of these Official Terms and Condition and disclosures or other statements contained in any Competition-related materials, including, but not limited to, the translations of these Officials Terms and Conditions, point of sale, television, print or online advertising and/or any instructions or interpretations of these Competition Terms and Conditions given by any representative of the Sponsor, the terms and conditions of these English Terms and Conditions shall prevail, govern and control to the fullest extent permitted by law.
SEVERABILITY
The invalidity or unenforceability of any provision of these Competition Terms shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Competition Terms shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE TROPHY COMPETITION OR WEBSITE MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY SUCH INDIVIDUAL AND SEEK DAMAGESTO THE FULLEST EXTENT PERMITTED BY LAW.
